Hurricane & Storm Procedures
Upon the issuance of a hurricane watch or warning, Landlord may, in its sole discretion, require the removal of the Vessel. If Tenant fails to timely remove the Vessel, Landlord may, but shall not be obligated to, move, haul, secure, or otherwise take action with respect to the Vessel, all at Tenant’s sole risk and expense. Landlord shall have no duty or obligation to remove, secure, protect, or safeguard the Vessel under any circumstances. Landlord shall have no duty to monitor weather conditions or to notify Tenant of storms, watches, warnings, or emergencies.
Landlord shall not be liable for any loss or damage to the Vessel arising from storms or weather-related events, except to the extent caused by Landlord’s gross negligence.
Storm Preparation:
In the event of an approaching storm predicted to cause dangerous conditions such as high winds and/or storm surge, Marina in its sole discretion may require Tenants to make mandatory storm preparations. Upon notice delivered by Marina via telephone, text message or email, Tenants are required to complete the following precautions within 24 hours:
- Remove all canvas and unattached deck furniture and equipment
- Remove sails or thoroughly lash sails to boom or furler
- Double all dock lines and spring lines, with adequate length to allow boat to rise/fall with predicted storm surge while preventing boat from contacting dock structure or pilings. Lines must be rigged to allow their length to be adjusted from the dock.
- Disconnect and remove shore power cords
- Close all seacocks
- Turn off all onboard powered devices, with the exception of bilge pump which must be fully functional, tested, and connected to fully charged battery(s).
Should Tenant fail to take these precautions within the 24 hour notice period, Marina may (but is not obligated to) complete some or all of them at its discretion and invoice boat owner for time and materials.
In the event of the most severe storm forecasts, Marina reserves the right to require Tenants to remove and relocate their vessels away from the marina entirely. Tenants are strongly advised to have a relocation plan in place well in advance, since haul-out services in the Pamlico River area quickly fill up when a serious storm is approaching.
